Q: What if I promote a benefit concert or a musical attraction where there is no charge for admission?
You would still have to pay a fee based on seating capacity ranges. (Please refer to Schedule B of the agreement for a listing of ranges and fees.)
Q: What is the provision for reporting co-promoted events?
In the event that the promoter/facility co-promotes an attraction, they must report to BMI as described in paragraph 5 (c) of the agreement and provide documentation of the responsible party for licensing fee payments. BMI will verify reported information through published sources such as Pollstar, Billboard, Performance Magazine etc.
Q: How is seating capacity determined?
In determining "Seating Capacity" the promoter/facility will include · the total number of seats permanently affixed in the facility where the attraction is presented plus any temporary seats added within the facility for a particular attraction. If the total number of seats available for the attraction is less than that of the permanent seating capacity of the facility, "seating capacity" will mean · the total number of seats available for the particular attraction. If a facility does not have permanent seating, "seating capacity" will mean · the total number of persons attending a particular attraction. If a facility has lawn seating, then "seating capacity" will mean · the total number of seats permanently affixed in the facility, in addition to total lawn seating capacity as determined by the local Fire Marshall.
Q: When do we report our musical attractions?
Promoters and Facilities must report and remit payments quarterly for each presentation during each period. For all quarterly periods, reports (on forms provided by BMI) and payments are due on the 20th of January, April, July & October of each year of the agreement.
